The Terms of Use (also called Terms, and also the Legally Binding Agreement, or simply called the Terms) between you (the User, Buyer, Seller, or you) and GlowlyMart (run by https://glowlymart.com) and governed by the following Terms, prescribe how you can access and be able to use the GlowlyMart site and all associated services (including browsing, purchasing, selling and all other types of functionality on offer by the Platform, as well as other uses not mentioned).

Using or visiting the Platform means that you have reviewed, read, and accepted these Terms, our Privacy Policy, and any other policies or guidelines posted on the Platform or communicated to you. You must not use or access the Platform unless you agree to these Terms.

  1. Acceptability of Terms

By your act of use of the GlowlyMart (https://glowlymart.com) platform, you are explicitly consenting to be bound by these terms and conditions that may be subject to variations by us at any time without notice. It is your responsibility to revise these Terms on a regular basis as you need to ensure there are no alterations to them. When you start using the Platform after a modification to the Terms, this will be interpreted that you agree to the new Terms.

  1. Registration and User Accounts

You need to create an account using the Platform so that you can access certain services of the Platform. To open an account, one has to be aged 18 years or above and have to be legally permitted to sign binding agreements as required by the law of the land in Ghana. By agreement, these are authorized upon registration: delivery of correct up to date, and full information, to date information on the registered information.

It is only you who is accountable for maintaining the password of your account as well as all the actions that are undertaken under your account to be confidential. You will obey us so that you can notify us when there is unauthorized access in your account.

  1. Role in Marketplace and Limitation of Liability

GlowlyMart is an online marketplace intended to provide a facility to link buyers and sellers together as well as provide a conduit through which they can carry out transactions with each other. We are not owners, sellers as well or inspectors of goods that were posted by sellers.

Actually, we are not the dealers with the buyers and their sellers. This is beyond our control, and we give no promises, warranties, or guarantees of the quality, safety, morality, or legality of any aspect of the things (their listings, description, seller’s ability to sell, or buyer’s ability to purchase items).

No liability or responsibility is assumed by us to you or anyone else with regard to any damages direct, indirect, incidental, special, consequential, or exemplary (actual or to be anticipated), including and without limitation, any loss of profits, goodwill, use, data, or other kinds of intangible loss. All the transactions of the Users are made at the risk of the Users.

  1. User Responsibilities and Prohibited Behavior

You will not use the Platform to engage in any unlawful behavior or to do anything that is in contradiction with these Terms or all the applicable laws and regulations in Ghana.

You should not:

(a) Upload, post, or otherwise use our platform to share any unlawful, threatening, harmful, abusive, defamatory, obscene, or in any other way offensive information or material, whether or not in breach of copyright or proprietary rights.

(b) attempt to deceive or misrepresent them or any other party, or make any false representations about yourself, your business, or your products;

(c) infringe the ideal property rights of any other person;

(d) interfere with, disrupt, or attempt to gain unauthorized access to any part of the Platform;

(e) send spam or harvest other information

In particular, the sellers have agreed to disclose honest information on descriptions, prices (in Ghana Cedis – GHS), and availability of all the listed products and delivery or delivery time of orders placed.

  1. Buying, Payments, and Pricing

You can buy and pay in Ghana Cedis (GHS). Buyers agree to pay the projected price of items purchased without delivery fee and taxes. GlowlyMart also deals with third-party secure publishers, with whom they carry their transactions. As you complete a checkout, the terms and conditions of the ensuing payment clearances at GlowlyMart are listed as follows: GlowlyMart reserves the right to place a hold on payments until the confirmation of a shipment to ensure protection in line with protection with the rest of the markets.

  1. Delivery Sellers

It will be the duty of Delivery Sellers to deliver products to buyers within the agreed duration. The buyers are obliged to provide accurate shipping information. GlowlyMart will take responsibility for shipping any delay, damage, and losses that a buyer may incur during shipping by the use of third-party carrier systems. The problem that has to do with shipping should be addressed mostly between the seller and the buyer.

  1. Returns, Refunds, and Cancellations

Return and refund, and cancellation policies are, to whatever extent they are available, entirely at the discretion of the individual seller and may be displayed where the individual goods are on offer or on the author pages. A customer will be encouraged to read such policies before purchasing him herself.

The suggestion that GlowlyMart could be of assistance to solve the dispute regarding some of the issues that arise should not adversely affect the fact that the seller has the final say over the matter of accepting returns or refunding buyers.   1. Dispute Resolution

In case of conflict occurrence between a buyer and the seller, we embrace the interaction that goes on directly between them with the view of settling the conflict as an amicable one. Provided that the direct solution fails, the Users may refer the matter to the customer support of GlowlyMart, which may serve as a mediator of the conflict. All disputes or cases with respect to or arising out of these Terms or is collapsed through the use of the Platform will be adjudicated in Ghanaian courts.

  1. Intellectual Property

All the contents in the Platform, like the text, the graphics, logo, the images, and the software, belong to GlowlyMart or the people that provide them and are afforded protection under both the Ghanaian and international copyright laws.

By doing so they grant GlowlyMart an exclusive license to use, reproduce, edit, and publish any of the materials (e.g. product photos, reviews, and descriptions) they upload on the Platform to the extent necessary to set it up, as well as to market it globally without any rights involved and without the compensation of any royalty whatsoever.

  1. Changes in Terms

The Terms could be changed at any time. The amended Terms will replace any formerly adopted and set in place on the Platform. Using the Platform after any such changes shall mean that you agree and accept the new Terms.

  1. Applicable Law

These terms shall be treated to interpret and governed by the law of the Republic of Ghana, excluding the choice or conflict of law provisions.

  1. Termination

You accept that we may close or suspend your account, in our sole discretion, at any time and without prior notice to you.
